THE DEVELOPMENT OF CHINA’S FOREIGN INVESTMENT LAW
By: LU Xuewu
ABSTRACT:
The Foreign Investment Law of the People's Republic of China (FIL) promulgated in 2019 marks the beginning of a new stage of the foreign investment legislation in China. In recent years, with the rapid development of China's economy, a comprehensive foreign investment law is needed to orderly guide and regulate foreign investment activities, create a more equitable investment environment for foreign capital to enter China, thus protecting the legitimate rights and interests of foreign investors and promoting the orderly development of foreign investment in China. The new Foreign Investment Law has adopted a more active opening-up policy, relaxed the approval of foreign capital, and streamlined the establishment procedures of foreign-funded enterprises. The new FIL is expected to build a stable, transparent, predictable and fair market environment in China and effectively protect foreign firms’ interest.
